Terms & Conditions

These terms outline the service framework between you and Maid Services in India. Please read them carefully before completing registration, confirming a placement, or continuing engagement with MSI.

Introduction

By registering with Maid Services India (MSI), you agree to these terms that govern our service process, responsibilities, and your rights as a client. MSI operates as an aggregator platform connecting households with independent domestic help service providers. We verify candidates, match profiles, and coordinate onboarding but do not directly employ or manage the domestic workers.

1. Registration Fee (One-Time & Valid for 5 Years)

A one-time, non-refundable registration fee begins the engagement and remains valid for five years from payment date.

  • Covers profile matching from our verified database, initial background checks, dedicated relationship manager support, and coordination with shortlisted candidates.
  • The fee is not adjusted against maid salary or service commission and expires automatically after five years without renewal options.
  • During the validity period you may re-engage MSI without paying the registration fee again—contact us directly to restart the process.

2. Service Fees or Charges (Due on Day of Placement)

Service Fees become payable once the selected maid commences work and are separate from salary paid to the worker.

  • A one-time service charge equal to one month of the maid’s salary is due on the placement date. It covers placement coordination, backend support, post-placement assistance, and eligibility for one primary placement plus up to three replacements within 12 months.
  • Service charges are calculated as a percentage of the mutually agreed salary between client and domestic worker.
  • Payment must be made to MSI’s official account via accepted channels (bank transfer, UPI, etc.). MSI is not liable for payments routed elsewhere; invoices/receipts are issued upon successful payment.
  • Registration and service fees are non-refundable irrespective of employment duration or termination circumstances. No pro-rata adjustments apply if the client stops employment before the 12-month period without requesting replacement.

3. Replacement Policy

Our replacement program supports continuity while ensuring fair transition windows for both parties.

  • A minimum gap of 15 days must exist between any two replacement requests within a calendar year. Urgent replacements inside this window incur an additional ₹500 per request.
  • Clients are entitled to a maximum of four placements in a 12-month period (initial placement plus up to three replacements), subject to candidate availability and adherence to the 15-day interval.
  • Replacements are provided for verified reasons such as domestic worker resignation/unavailability, substantiated performance issues, or medical circumstances preventing continued service.
  • Replacements are excluded for unrealistic expectations, personality conflicts without documented performance issues, post-placement changes in requirements, or failure to complete necessary verification steps.

4. Police Verification and Background Checks

MSI offers preliminary screening, while official police verification remains the client’s responsibility.

  • Clients must complete police verification within one month of placement and share proof with MSI.
  • MSI conducts identity confirmation, reference checks, and experience validation; this does not guarantee character or future conduct.
  • MSI is not liable for incidents arising from incomplete or absent police verification by the client.
  • Verification dossiers assembled by MSI are shared within 4–5 working days after full payment of service fees.

Note: Clients should initiate police verification immediately—especially for live-in staff—and exercise independent due diligence at all times.

5. Client Obligations and Default Conditions

  • Provide accurate service requirements and maintain professional, lawful employment practices.
  • Conduct police verification prior to engagement and pay salaries/statutory benefits directly to the worker.
  • Implement adequate security measures, monitor premises, and keep MSI informed about changes to job scope or employment status.
  • MSI is not liable where clients ignore verification duties, breach labour laws, supply misleading information, delay reasonable matches, or neglect recommended security protocols.

6. Service Receiver Responsibility

The Service Receiver (client) remains fully responsible for workplace conditions throughout the employment period.

  • Ensure a safe, respectful, and healthy environment with reasonable hours, rest, and grievance redressal.
  • Comply with applicable state labour laws regarding domestic workers, including leave policies and holidays.
  • MSI’s verification supplements—but does not replace—the client’s ongoing due diligence.

7. Salary Terms

  • Salary and employment terms are decided directly between the client and the maid; MSI does not intervene in negotiations.
  • Clients must pay wages promptly (e.g., by the 7th of each month) for all days worked and meet minimum wage guidelines where applicable.
  • Non-payment terminates the MSI service agreement and may result in legal recovery actions by the maid or agency. Maintain records such as signed receipts or bank statements.

8. Unauthorized Hiring or Continuation

Hiring without notifying MSI, clearing service fees, or receiving verification documents voids MSI liability and may trigger legal remedies for outstanding dues or damages.

9. Travel & Transit Costs

Clients bear all travel, relocation, and transit expenses for the domestic worker’s journey to and from the premises.

10. Exit Check & Belongings

  • Clients may conduct respectful belongings checks at exit in the presence of the maid.
  • MSI is not responsible for theft or loss reported after the maid leaves. Report suspected incidents immediately to MSI and local authorities.

11. Police Support

MSI assists with documentation and verification records in the event of theft, misconduct, or police cases—clients must notify MSI and authorities without delay.

12. Legal Jurisdiction

Unresolved disputes fall under the exclusive jurisdiction of courts in Jaipur, Rajasthan, India.

13. Confidentiality and Data Privacy

MSI safeguards personal data, sharing it only with consent, to deliver services, or as required by law, in accordance with applicable data protection principles.

14. Force Majeure

Neither party is liable for failure or delay caused by events beyond reasonable control, including natural disasters, war, civil unrest, pandemics, or strikes.

15. Responsibility of Company

MSI strives to supply verified candidates but cannot guarantee behaviour, character, or tenure, which depend on personal relationships and individual circumstances. MSI’s role is that of a facilitation agency offering replacements per these terms.

16. Severability

If any provision is deemed invalid or unenforceable, the remaining terms continue in full force.

17. Liability Limitation

MSI is not liable for indirect, incidental, or consequential damages—including emotional distress or reputational loss—except in cases of gross negligence or fraud directly attributable to MSI.

18. Entire Agreement

These Terms & Conditions supersede all prior discussions or agreements between the client and MSI regarding our services.
